These Terms of Use ("Terms") govern your access to and use of billemmsleyscholarship.org (the "Site"), operated by the Bill Emmsley Jr. Scholarship Fund ("the Fund," "we," "us," or "our"). By accessing the Site, submitting a scholarship application, or submitting a donor inquiry, you agree to these Terms. If you do not agree, please do not use the Site.
The Site provides information about the Bill Emmsley Jr. Scholarship Fund, allows prospective students to submit scholarship applications, and allows prospective donors to submit inquiries about supporting the Fund.
Scholarship eligibility criteria (including American Samoa residency status and academic program requirements) are described on the Site's application page and may be updated from time to time. It is your responsibility to review current eligibility requirements before applying.
Applying does not guarantee a scholarship. The Fund decides awards at its sole discretion, based on the information available when it reviews applications. The Fund may change, pause, or end the scholarship program or any of its terms at any time without prior notice.
You agree to give accurate, current, and complete information in your application or donor inquiry. False, misleading, or fraudulent information may lead to disqualification at any stage, including after an award has been made.
When using the Site, you agree not to:
The Site's text, design, logo, and images belong to the Fund or its licensors and are protected by intellectual property laws. You may view and share Site content for personal, non-commercial purposes. You may not copy, distribute, or build on it without our prior written permission.
The Site relies on third-party providers for web hosting, data and document storage, email delivery, and bot protection to run its application and donor inquiry forms. Their own terms may also apply to your use of the Site where relevant. See our Privacy Policy for how they handle your information.
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not promise that the Site will always be available, error-free, or secure. If the Site is down, an application may fail to submit, so please allow time before any deadline.
To the fullest extent the law allows, the Fund and its officers, directors, and volunteers are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site, your application, or your donor inquiry.
These Terms are governed by the laws applicable in American Samoa, without regard to conflict-of-law principles.
We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
