These Terms of Use ("Terms") govern your access to and use of billemmsleyscholarship.org (the "Site"), operated by the Bill Emmsley Jr. Scholarship Fund ("the Fund," "we," "us," or "our"). By accessing the Site, submitting a scholarship application, or submitting a donor inquiry, you agree to these Terms. If you do not agree, please do not use the Site.
The Site provides information about the Bill Emmsley Jr. Scholarship Fund, allows prospective students to submit scholarship applications, and allows prospective donors to submit inquiries about supporting the Fund.
Scholarship eligibility criteria (including American Samoa residency status and academic program requirements) are described on the Site's application page and may be updated from time to time. It is your responsibility to review current eligibility requirements before applying.
Submitting an application does not guarantee that you will receive a scholarship. Award decisions are made at the sole discretion of the Fund based on the information available at the time of review. The Fund reserves the right to modify, suspend, or discontinue the scholarship program, or any of its terms, at any time and without prior notice.
You agree to provide accurate, current, and complete information in your application or donor inquiry. Submitting false, misleading, or fraudulent information may result in disqualification from the scholarship program at any stage, including after an award has been made.
When using the Site, you agree not to:
The Site's text, design, logo, and images are owned by the Fund or its licensors and are protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but may not reproduce, distribute, or create derivative works from it without our prior written permission.
The Site relies on third-party service providers — including Supabase (data storage), Resend (email delivery), and Cloudflare (bot protection) — to operate its application and donor inquiry pipelines. Your use of the Site is also subject to the applicable terms of those providers where relevant. See our Privacy Policy for more detail on how these providers process your information.
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, the Fund and its officers, directors, and volunteers will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site, your application, or your donor inquiry.
These Terms are governed by the laws applicable in American Samoa, without regard to conflict-of-law principles.
We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
